#MixxNews: Man Charged with 2 Felonies for Running Over 21-Year-Old Woman

A woman underwent surgery Monday in a Birmingham hospital after being run over by a car in Anniston while celebrating her 21st birthday Sunday with friends and family. 21-year-old Margie Mitchell, of Detroit, was struck by a vehicle in a parking lot outside the nightclub Ambitions on 1800 S. Quintard Ave. at about 3 a.m., according to witnesses.

Mitchell was struck and run over by a white, four-door Lexus driven by Nikolaus Danvar Mitchell, 35, of Oxford, who has since been arrested and charged with first-degree assault and leaving the scene of an accident with injuries, both felonies.

Mitchell suffered spinal injuries, a broken pelvis, arm and ribs, and burns from the vehicle’s tires. She underwent surgery at UAB Hospital in Birmingham on Monday and is in stable condition.  Destiny Lawson, Mitchell’s cousin, who was with the victim at the club, said Tuesday that doctors at UAB Hospital in Birmingham had kept Mitchell sedated after surgery Monday due to severe pain, and she remained in that condition.

Mitchell made it through surgery fine, Lawson said, but she added that doctors told the family it was too early to know whether she’ll need more surgery or how long her recovery will take.

“They’re still trying to see if they’re going to have to do anything else to her,” Lawson said.

Lawson said Tuesday that the defendant and her cousin are not related, and did not know each other before the incident.

Anniston police Capt. Allen George in a press release Tuesday wrote:

“A search warrant for the vehicle was secured and APD Crime Lab investigators processed the vehicle and were able to recover physical evidence linking the vehicle to the crime,” George wrote.

Nikolaus Mitchell is being held in the Anniston City Jail. The release states that his bond is set at $400,000.


Calhoun County District Attorney Brian McVeigh said while Mitchell has been charged with two felonies, he could still be charged with more serious crimes. Charges were filed against Mitchell based on what was apparent at the scene of the incident, but a grand jury will look over all evidence to see whether additional charges are warranted, according to McVeigh.

“As they continue to interview witnesses, and the situation with the victim develops, that evidence will be taken to a grand jury for them to decide,” McVeigh said.

McVeigh said a grand jury could charge him with reckless or intentional attempted murder.

“The main priority at this point was to get a very dangerous person off the streets,” McVeigh said.

Prayers goes out to the Mitchell family in hopes that Mitchell will have a speedy recovery. Mitchell does not have health insurance and the family has set up a GoFundMe account in order to pay for Mitchell’s medical bills.
